Instead of using other verse references, Rashi infers meaning based on his GENERAL KNOWLEDGE OF ATTRIBUTES of LAWSUITS. STANDARD EXAMPLE Dt20-03 states that in a war we should - not be SOFT-HEARTED - not be AFRAID - not be ANXIOUS - not be STUNNEd There is no basis- in the dictionary or verses to relate these items to more specific nuances. Rashi simply lists the 4 components of war - FEAR OF TRANSPORTATION SUPERIORITY - FEAR OF COMMUNICATION SUPERIORITY - FEAR OF SUPERIOR MORALE - FEAR OF SUPERIOR RESOURCES The only way to justify this Rashi is to connect the 4 words used with the 4 known aspects of war. Thus this is inference based on EXPERTISE. Simply--the whole idea of a law suit is that 2 people interpret the same action differently. Thus I might claim you owe me money because of a loan and you might counter that you perceived the loan as a payoff of a previous debt and not a new loan.
