JUDGES: Wise,Known

RASHIS COVERED: Dt16-18d Judges should be wise & known to people

VERY BRIEF SUMMARY:

-- Dt16-18 states Appoint JUDGES & POLICE in all CITIES in the
-- land that God gives you to your tribes &they-ll judge properly
Rashi states that there are 3 criteria for judge appointment
- They must be wise
- They must be from the city
- They must be from the tribe
But Dt16-18 doesnt really speak about WISDOM and appointing
judges from tribes. Rashis real derivation comes from an OTHER
VERSE--Dt01-13 which explicitly states
-- Appoint WISE judges who are KNOWN TO YOUR TRIBES

TODAYS RASHI RULE: OTHER VERSES
TODAYS RASHI SUBRULE: FURTHER DETAILS
-----------------

This module began yesterday. We showed that
the requirements of WISDOM and BY TRIBES for Judges could
be more easily derived from the explicit statement in Dt01-13
(The requirement of having JUDGES by CITY is however more
explicitly stated in Dt16-18).

REQUIREMENT IN Dt16-18 OTHER VERSE-Dt01-13

Wise judges They will judge righteously Wise Judges
Belong to city Place in all your cities Known to you
Belong to tribe that God gives to tribes Known to your tribes

Todays list compares several dozen verses which speak about
Israel as the LAND WHICH GOD GAVE US. Some of these
verses add extra words to this phrase. Thus Dt16-18 speaks
about the land which God gave us TO OUR TRIBES.

This phrase,TO YOUR TRIBES is extra.

Rashi states that Judges must be picked BY TRIBE and CITY.
However Rashi does not really derive the TRIBAL requirement
from this extra phrase. Rather Rashi derives this tribal
requirement from the explicit OTHER VERSE Dt01-13...PICK
JUDGES THAT ARE KNOWN TO YOUR TRIBES!!!

This affords us an example of the difference between Dr
Leibowitzs-Rabbi Bonchecks approach and mine.
VERSE GOD GIVES ISRAEL ADDED PHRASE
Ex20-12 WHICH GOD GIVES YOU
Dt04-21 WHICH GOD GIVES YOU for inheritance
Dt12-09 WHICH GOD GIVES YOU
Dt13-13 WHICH GOD GIVES YOU to dwell
Dt15-04 WHICH GOD GIVES YOU for inheritance to inherit
Dt15-07 WHICH GOD GIVES YOU
Dt16-18 WHICH GOD GIVES YOU to your tribes*10
Dt17-14 WHICH GOD GIVES YOU
dt18-09 WHICH GOD GIVES YOU
Dt19-02 WHICH GOD GIVES YOU
COMMENTS

*10 The Leibowitz-Boncheck school explain Rashis by extra words
Since TO YOUR TRIBES is extra, therefore, they argue,
Judges must be assigned BOTH by CITY and TRIBE.

The approach of this email list is different. True, the
phrase to your tribes is extra but this extraness does
   NOT justify rearranging the verse.

In other words the EXTRANESS of TO YOUR TRIBES may
be BOTHERING Rashi but it is NON-INTUITIVE to rearrange
the verse in response to this EXTRANESS.

The approach in this email list which we have taken is
to give an explanation which makes Rashi appear
SPONTANEOUS and LOGICAL--an other verse says explicitly
PICK JUDGES WHO ARE KNOWN TO YOUR TRIBES. This derivation
from an other verse is clear, punchy and to the point.

As to the literal reading of Rashi (who suggests
rearranging the verse) I would simply take the same
approach we have always taken in this list---the
rearrangement is simply a mnemonic not the real reason
Indeed, why should we accuse Rashi of overlooking an
explicit verse which states that Judges should be
   by tribes.

Thus this Rashi is an excellent illutration of the
difference in approach between Dr Leibowitz and
Rabbi Boncheck vs this email list
