GOALS
=====
This module studies the ALIGNMENT method in Rashi. In this
method 2 different verses are found to be ALMOST the same.
The verses are lined up and the minor differences between
them function as footnotes illuminating the text.

TODAYS UNIT
===========
In todays unit we align 2 verses dealing with
being a good judge.

ALIGNMENT OF TWO VERSES ON INTERMARRIAGE #1

BACKGROUND
----------
The Torah describes how Moses made a hierarchical system of
judges

THE TEXT
--------
Moses says he will appoint Judges if they have good judge
attributes such as being religious, being wise etc.

THE RASHI
---------
But the LIST in Moses request to the nation and the LIST
in what the nation brought are different!

Let us review this one difference and see how Rashi, Rambam
and Sifrah/Sifray treat it.
VERSEPHRASE1PHRASE2PHRASE3 PHRASE4 PHRASE5 PHRASE6
Dt05-13 bring me--- RIGHTEOUS WISE ANALYTICAL RESPECTED PEOPLE
Dt05-15you broughtRIGHTEOUSWISE ---------- RESPECTED PEOPLE
Differs*1*2*2 *3*2 *2 *2
COMMENTS

*1 Dt01-13 mentions Moses REQUEST to bring people while
Dt01-15 mentions the nations COMPLIANCE with this request

*2 These phrases are the same in both chapters. Note that we
have placed the word PEOPLE at the end of the verses to make
   it sound better in English.

Further note that Rashi points out that the word ANASHIM(or
ISH), normally translated as MEN, should really be translated
as MENCHES--distinguished, righteous people. We will have a
separate posting on the use of this word. In this posting
   we concentrate on the alignment.

*3 Moses REQUESTED people with 4 attributes but the nation
only brought back people with 3 attributes. So Rashi
is Simple: The 4 attributes are PREFERRED but NOT
REQUIRED. Rambam (Courts, Chapter 2) says this more
   explicitly.

Three other comments are in order:
-Note that ANALYTIC is the HARDEST of the 4 attributes Moses
listed to acquire. There are many individuals who are WISE
(Know laws), are RESPECTED and RELIGIOUS. Finding ANALYTIC
    individuals is hard.

Thus it emerges that the Bible simply
told us that it was hard to find ALL 4 attributes in some
individuals--and Moses apparently accepted them. From this
fact we INFER that having all 4 attributes are not essential

-The Sifrah, Rashi and Rambam bring in the Sister verse
   -------------------------------------------------------------
Ex18-21 Pick WEALTHY, HONEST, CHARITABLE, EASY GOING PEOPLE
           and make them judges
   -------------------------------------------------------------
THere are many approaches to these two verses. The simplest
approach is that there are two possible tracks for judges.
    * There are judges who are wealthy but honest and charitable
    * Judges who are wise, righteous, analytic

A real Judge should have all 8 characteristics. But as we
just saw although this is preferred it is not required. I
would further add that judges may lean more to the
honest-wealthy type or the religious-wise type.

-In our EXAMPLE series we have show how these 2 verses
describe CLIMACTIC ORDER. E.g. First you are RELIGIOUS
    and non-impetuous; then you become WISE (learn laws);
then you acquire your own UNDERSTANDING; finally you
are able to be EMPATHIC with all sides in a case (and
you become instantly FAMILIAR to everybody)--such an
    empathy helps being a judge.

    this basic concept.
