GOALS
=====
This module studies the ALIGNMENT method in Rashi. In this
method 2 different verses are found to be ALMOST the same.
The verses are lined up and the minor differences between
them function as footnotes illuminating the text.
TODAYS UNIT
===========
In todays unit we align 3 verses discussing payment for damages.
REFERENCE:
=========
Todays unit comes from the following posting

Alignment of 3 Verses on Paying for Damages |
EXAMPLE 66: Ex22-04d Discussion of how damages are payed for
EXAMPLE 67: Ex21-34b Discussion of how damages are payed for
BACKGROUND
----------
Ex21-28 thru Ex22-05 discuss various types of damages that
can be afflicted. In each case the method of payment is
indicated.
THE TEXT
--------
There are separate Biblical paragraphs for
-- damage by a goring ox
-- damage by a pit
-- damage by a fire
THE RASHI
---------
From the various differences in the paragraphs Rashi infers that
-- damages should be paid first from money
----------------------- then from money equivalants(eg jewelry)
----------------------- then from good real estate
----------------------- then from poor real estate
THE LIST
--------
The following novelty are illustrated in todays posting
-- we should review ALL differences in a list even those Rashi
does not comment on (eg See Footnote #3)
-- We have emphasized what Rashi learns from ALIGNMENT vs from
GRAMMAR. For example most students know how to learn from
RETURN THE MONEY (vs PAY THE MONEY) that you can pay by
A NON-PAYMENT RETURN (e.g. jewelry). What we have
emphasized is that there are 2 verses: One says PAY and one
says RETURN and it is this ALIGNMENT which justifies the
Rashi
Here is the list. |
VERSE | TORT CASE INVOLVED | PHRASE1 | PHRASE2 |
Ex21-34 | The owner of a PIT must pay: | MONEY | will be returned |
Ex22-04 | Owners of DAMAGING ANIMALS: | BEST LAND | will be payed |
Ex22-05 | Owners of FIRE: | | will pay pay |
| *1 | *2 | *3 *4 |
| | | |
COMMENTS |
*1 We deal with 3 cases of damages:
-- damages by FIRE
-- damages by my PIT
-- damages by ANIMALS
*2 The use of the terms >MONEY< and >BEST LAND< implies that
the damager should pay money OR, if he doesn't have money,
he should pay from the best of his real estate (In other
words if he owes a $1000 for the damage he must give a
$1000 of real estate from a good neighborhood and may not
initially pay $1000 of real estate from a bad neighborhood)
*3 The repeated word PAY PAY follows the rules of REPEATED words
discussed in http://www.RashiYomi.Com/doubl-14.htm
In general a repetition denotes that something happens no
matter what. In this case it means that payment will happen
no matter what. This means if a person does not have MONEY
or GOOD REAL ESTATE then he pays from inferior real estate
*4 Two verses say >PAY< while one verse says >RETURN< implying
that it is permissable to either >PAY MONEY< or >RETURN
VALUABLES< (eg jewelry) of comparable value to the damaged
object.
