But Dt16-18 doesnt really speak about WISDOM and appointing
judges from tribes. Rashis real derivation comes from an OTHER
VERSE--Dt01-13 which explicitly states

BRIEF DESCRIPTION OF THE RULE and SUBRULE

The rule of OTHER VERSES simply means that Rashi
is explaining one verse by citing an OTHER VERSE

One way of doing this is to cross reference a
verse that speaks about the SAME topic but gives
FURTHER details.

The following example comes from the Passover
Hagaddah

Dt26-05 states that

 Jews go down to Egypt

The student is then instructed to discover

Here are the 2 verses on judges. Note especially how
one verse is clearer than the other. In a second list
we show how there is an anomaly and problem in Dt16-18
Nevertheless the method of OTHER VERSES is simpler. This
affords us an opportunity to discuss the difference between
Leibowitz-Boncheck and this email list.

*2 In this case the current verse which states explicitly
   PLAcE JUDGES IN ALL CITIES is clearer than the OTHER
   VERSE which simply says that the Judges should be
   KNOWN to YOU

   reattaching the phrase to another part of the verse

   THerefore I derive the TRIBAL REQUIREMENT
   from the explicit verse in Dt01-13 that judges
   should be appointed THAT ARE KNOWN TO YOUR TRIBES. Thus
   indeed Rashi-is-Simple*10

----------------------- LONGER FOOTNOTES -----------------------

*10 The Leibowitz-Boncheck school explain Rashis by extra words
   Since TO YOUR TRIBES is extra, therefore, they argue,
   Judges must be assigned BOTH by CITY and TRIBE.

   The approach of this email list is different. True, the
   phrase to your tribes is extra but this extraness does
   NOT justify rearranging the verse.

   In other words the EXTRANESS of TO YOUR TRIBES may
   be bothering Rashi but it is NON-INTUITIVE to rearrange
   the verse in response to this EXTRANESS.

   The approach in this email list which we have taken is
   to give an explanation which makes Rashi appear
   SPONTANEOUS and LOGICAL--an other verse says explicitly
   PICK JUDGES WHO ARE KNOWN TO YOUR TRIBES. This derivation
   from an other verse is clear, punchy and to the point.

   As to the literal reading of Rashi (who suggests
   rearranging the verse) I would simply take the same
   approach we have always taken in this list---the
   rearrangement is simply a mnemonic not the real reason
   Indeed, why should we accuse Rashi of overlooking an
   explicit verse which states that Judges should be
   by tribes.

   Thus this Rashi is an excellent illutration of the
   difference in approach between Dr Leibowitz and
   Rabbi Boncheck vs this list.

 This list compares several dozen verses which speak about
 Israel as the LAND WHICH GOD GAVE US. Some of these
 verses add extra phrases. Thus Dt16-18 speaks about
 THE LAND WHICH GOD GAVE US TO OUR TRIBES. This phrase,
 TO YOUR TRIBES is extra. Rashi states that Judges must be
 picked BY TRIBE and CITY. However Rashi does not really derive
 the TRIBAL requirement from this extra phrase. Rather Rashi
 derives this tribal requirement from the explicit OTHER VERSE
 Dt01-13...PICK JUDGES THAT ARE KNOWN TO YOUR TRIBES!!!
