        ------------------------------------------------------

RULE
====
The words >THE< can be used in 4 ways

--THE can refer to a proper noun

--THE can refer to something that is mentioned nearby

eg Dt04-32c >Has anyone heard THE GREAT THING-that God
saved a nation enslaved in another nation with great miracles<

Thus the phrase >THE GREAT THING< refers to the verse that
follows >That God saved a nation enslaved in another nation<

--THE can refer to a concept, story or thing mentioned
  ELSEWHERE (but not immediately afterwards)

  eg Nu13-33a >We saw there THE Nefilim<
This refers to the NEFILLIM nation mentined in Gn06-04

--THE can refer to the best known of a class

eg Dt01-07e >THE Mount< -- This refers to The Kings Mountain

EXAMPLE 75: Ex22-12a
====================
BACKGROUND
----------
The Bible is discussing the 3 types of watchers. In other words
you say give a watch to someone. The watch then gets lost, stolen
or broken. Is the person you gave it to (the WATCHER) responsible?

The Bible enumerates 3 categories of WATCHERS

CASE 1
------
IF The WATCHER
---does NOT get paid to watch and
---YOU asked him to watch
THEN
---the WATCHER is NOT monetarily liable unless he was negligent
(After all he did you a favor)

CASE 2
------
IF the watcher
---does NOT get paid to watch and
---HE loaned the watch from you
THEN
---the WATCHER is ALWAYS liable.

CASE 3
------
IF the watcher
---does get paid to watch and
---YOU asked him to guard it
THEN
---THE WATCHER is responsible for theft
---the WATCHER is NOT responsible for ARMED ROBBERY
(In other words since you are paying him therefore the
WATCHER must make every effort to protect against theft
but the WATCHER is not responsible to fight armed robbery)

THE VERSE: If the WATCH was DESTROYED (by others) then...
for THE destruction he need not pay

THE RASHI: The verse does not say
           ---------------------------------------------
for A destruction he need not pay
           ---------------------------------------------

           but rather says

           ---------------------------------------------
for THE destruction he need not pay
           ---------------------------------------------

THE, here refers to a the BEST TYPE OF desctruction. So if eg
there was an ARMED ROBBERY of a watch or eg a LION ate a kitten
(that was being watched) then the WATCHER is not liable.

But if someone broke into the house and took the watch or if
eg a dog ate the kitten then the WATCHER IS LIABLE.

COMMENTS: In talmudic lingo
          ---------------------------------------------
The paid guard is responsible for SMALL accidents
but he is not responsible for BIG accidents
          ---------------------------------------------

          In BIBLICAL LINGO
          ---------------------------------------------
The paid guard is responsible for A destruction
but he is not responsible for THE destruction
          ---------------------------------------------

Thus the word THE here refers to the best of destructions
Note the underlying unity between BIBLICAL and TALMUDIC langauge
